Statewide standing order

No statewide order, but the statute expressly authorizes NON-PATIENT-SPECIFIC prescriptions and pharmacist dispensing to entities. OCFS also runs a free Non-Patient Specific Auto Injector Initiative supplying licensed child care programs with up to 3 doses of AUVI-Q plus a trainer.

How to get it in New York
Two documents: a prescription in your organization's name, and a standing order saying when trained staff may use it.

- New York does not issue a statewide standing order, so a prescriber signs yours. Any physician can, and in most states a nurse practitioner or PA can too.

Religious halls, granges, public associations and free libraries are exempt. All other entities are broadly PERMITTED under PHL §3000-c.
Pending legislation

Would require every licensed child day care center to keep at least two epinephrine devices on site, with a trained staff member present whenever children are present, annual training, incident logs, and 24-hour parent notification.
Passed both chambers June 3, 2026. NOT SIGNED and not yet delivered to the Governor as of Aug 14, 2026. Effective 180 days after becoming law. RE-CHECK BEFORE RELYING ON THIS.
